This is Marvel Comics, where the two superhero lawyers handle every single case where superheroes are on trial individually or collectively, and Doc Sampson once brought up events told to him in other people's confidential therapy sessions to needle and criticize Jamie Madrox. I don't think conflict of interest is recognized as a concept in the Marvel Universe.

And so on and so forth. Even if Scott can't prove that Cross is a criminal, he doesn't have to to have a defense.

But this is Spencer, who can't write a character who isn't a losing loser who loses losingly.

Why wouldn't it be? Scott's served on both the FF and Avengers, and can prove at the very least that his daughter was attacked and literally lost her heart.

I very much doubt that a jury would be more sympathetic to a CEO suspected vs. an Avenger of good standing

In the MU, they have suits of armor that can fly into space like it was crossing the street. A DNA scanner that doesn't require surgery is nothing compared to that.
